These Terms & Conditions (“Terms”) govern your access to and use of the SafeHire Group website located at http://www.safehiregroup.com/ and any related services, products, software, portals, reports, tools, and support (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Services.

2) Who the Services Are For
SafeHire Group provides background screening and related services primarily for businesses and authorized users (“Clients”) for lawful purposes such as employment, contracting, or other permissible business needs.
The Services are not intended for personal, family, or household use.
3) Definitions

“Client” means the business entity and its authorized users who request Services.

“Consumer” means the individual who is the subject of a background check or report.
-
“Report” means any background screening result, verification, or related output provided through the Services.

“FCRA” means the Fair Credit Reporting Act (15 U.S.C. §1681 et seq.), where applicable.
4) Permitted Use & Client Certification
By using the Services, Client represents and warrants that:

Client has a permissible purpose to request Reports under applicable law (including FCRA when applicable).

Client will use Reports only for lawful purposes and only as permitted by applicable law.

Client will comply with all applicable laws, regulations, and local rules, including (where applicable) FCRA, state consumer reporting laws, and adverse action requirements.

Client will maintain internal policies and access controls so only authorized personnel can request or view Reports.
SafeHire Group may require additional certifications, agreements, or documentation prior to providing Services.
5) Client Responsibilities (Important)
Client is solely responsible for:
-
Obtaining any required written authorization/consent from the Consumer before ordering a Report, where required by law.

Providing required disclosures and notices to the Consumer (including FCRA disclosures when applicable).

Using Reports in a manner consistent with the Client’s stated purpose and applicable law.
-
Following applicable pre-adverse action and adverse action procedures before making a final decision based in whole or in part on a Report, where required by law.

Ensuring the accuracy of information submitted to SafeHire Group (names, DOB, SSN where applicable, addresses, etc.).
6) Consumer Disputes & Reinvestigation
If a Consumer disputes the accuracy or completeness of information contained in a Report, SafeHire Group will handle disputes in accordance with applicable law and internal procedures.
Clients agree to:

Direct Consumers to SafeHire Group for disputes when appropriate; and
-
Not discourage or interfere with any lawful dispute process.

7) Ordering, Turnaround Times & Availability
Turnaround times may vary due to:
-
jurisdictional court access and processing times,
-
third-party verification response times,
-
the completeness/accuracy of information provided, and
-
system availability or maintenance.
All turnaround times are estimates and not guaranteed.
8) Fees, Billing & Refunds
Fees for Services depend on the package and screening options selected. Unless otherwise stated in a separate written agreement:

All fees are due as invoiced or at the time of order.

Completed searches and third-party pass-through costs are generally non-refundable, even if the result is “no record,” the candidate withdraws, or the hiring decision changes.

If an order is canceled before processing begins (where possible), SafeHire Group may issue a partial refund at its discretion, minus any incurred costs.

9) Acceptable Use & Prohibited Activities
You agree not to:
-
Use the Services for stalking, harassment, intimidation, discrimination, or any unlawful purpose.
-
Request Reports without a permissible purpose or required consent.
-
Attempt to access, copy, scrape, reverse engineer, or disrupt the Services, systems, or security controls.
-
Misrepresent your identity, authority, or the purpose for which you request a Report.
-
Share Reports with unauthorized parties or use them outside the permitted purpose.
SafeHire Group may suspend or terminate access for suspected violations.
10) Confidentiality & Data Handling
Reports and related data may be sensitive. Client agrees to:
-
Keep Reports confidential and restrict access to authorized personnel.
-
Store and transmit Reports securely.
-
Comply with all applicable privacy, data security, and record retention obligations.

Dispose of Reports securely when no longer needed.
SafeHire Group may maintain a separate Privacy Policy and/or Data Policy governing how information is collected and used.
11) Third-Party Sources
Some information in Reports may come from third parties (courts, educational institutions, employers, labs, or other sources). SafeHire Group does not control third-party systems or response times and cannot guarantee that all third-party data is error-free or available at all times.
12) No Legal or HR Advice
SafeHire Group provides screening information and services. We do not provide legal advice, HR advice, or hiring decision recommendations. Clients are responsible for interpreting Reports and complying with applicable laws.
13) Intellectual Property
All website content, branding, logos, text, graphics, and software used to provide the Services are owned by SafeHire Group or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written permission.
14) Service Changes, Suspension & Termination
SafeHire Group may modify, suspend, or discontinue any part of the Services at any time. We may suspend or terminate your access if we believe you:
-
violated these Terms,
-
used the Services unlawfully, or
-
pose a security, compliance, or reputational risk.
Termination does not eliminate payment obligations for services already performed or costs already incurred.
15) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEHIRE GROUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SafeHire Group does not guarantee hiring outcomes, candidate suitability, or uninterrupted availability.
16) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEHIRE GROUP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
SAFEHIRE GROUP’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT PAID BY CLIENT TO SAFEHIRE GROUP FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS PRECEDING THE EVENT.
Some jurisdictions do not allow certain limitations, so some portions may not apply to you.
17) Indemnification
Client agrees to indemnify and hold harmless SafeHire Group and its officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from:

Client’s misuse of the Services,
-
Client’s violation of law,
-
failure to obtain required consent, or
-
improper adverse action procedures or disclosures.
18) Governing Law & Venue
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute not otherwise restricted by applicable law will be brought in state or federal courts located in Maricopa County, Arizona, and you consent to that jurisdiction and venue.
19) Changes to These Terms
We may update these Terms from time to time. Updates will be posted on the website with a revised “Last Updated” date. Your continued use of the Services after changes become effective constitutes acceptance.
